PETITION OF JOSEPH P KENNEDY 1810

MISSISSIPPI TERRITORY of the UNITED STATES Baldwin County December 1, 1810

To the Honorable the Judge of the Superior Court for Washington District.--

The Petition of Joseph P Kennedy a Citizen of the state of West Florida, and officer under the Government of the Convention of West Florida--Humbly sheweth, that on or about the 4th of Nov last he notified the Citizens of the Miss Territory that in a few days he would leave the U States by public advertisement, and that agreeable to the said advertisement he left the U. States and became a Citizen of the state of West Florida--that after his residence in the said state of West Florida He received a commission in the army of the Convention of West Florida as a Colonel of the Mobile Regiment, under which commission he has acted as an officer aforesaid and was furloughed by Colonel R. Kemper his commanding officer on the 6th of December to go to the U. Stats of America and that on the 7th of the aforesaid last mentioned month he was arrested by a warrant under the hand and seal of John Johnston Chief Justice of Baldwin County for setting on foot a foreign expedition against the Spanish Government with which the U States are now at peace, and was bound over to appear at the next Superior Court for Washington district Himself in the sum of three thousand Dollars and each of his securities in the sum of on thousand Dollars---

He therefore humbly prays that your honor will grant unto him the writ of Habeas Corpus ad subjiciendum to be directed to John Johnston Esq. to bring up before your Honor the Warrant, the bond aforesaid and the cause of the arrest aforesaid on monday next at Fort Stoddert--and that Justice may be done, and your petitioner discharged from the bail aforesaid as an officer in the government of West Florida, and your petitioner will ever pray
